This Privacy Policy ("Policy") describes how App2Mobile, LLC d/b/a App2Food ("App2Food," "we," "us," or "our") collects, uses, shares, and protects information about you when you use our website, mobile application, kiosk ordering system, and all associated services (collectively, the "Platform").

This Policy applies to all users of the Platform, including restaurant customers placing orders ("Customers") and restaurant businesses registered on the Platform ("Restaurant Partners").

Please read this Policy carefully. Your use of the Platform is also governed by the applicable App2Food Terms of Service. If you do not agree with this Policy or the applicable Terms of Service, please discontinue use of the Platform.


1. WHO WE ARE

App2Food is operated by App2Mobile, LLC, a New Jersey limited liability company. We provide a commission-free digital ordering platform for restaurants and food service businesses throughout the United States.

2. INFORMATION WE COLLECT

We collect information in the following ways:

2.1 Information You Provide Directly

For Customers, we collect:

  • Name, email address, phone number, and delivery address when you create an account or place an order;
  • Payment card information needed to complete a purchase. Full payment card numbers and CVV codes are collected and processed by Square. App2Food may receive limited payment-related information, such as transaction status, card brand, last four digits, payment confirmation details, and order amount, but we do not store full card numbers or CVV codes;
  • Order history, item selections, and special instructions;
  • Loyalty program activity including points earned and redeemed;
  • Gift card purchase and redemption activity;
  • Communications you send to our customer support team;
  • Reviews or feedback you submit through the Platform.

For Restaurant Partners, we collect:

  • Legal business name, DBA, and physical address;
  • Federal Employer Identification Number (EIN);
  • Primary owner or authorized representative name and government-issued identification;
  • Business bank account information for payment disbursement via Dwolla;
  • Sensitive business and identity verification information, including owner or authorized representative information, government-issued identification, EIN, beneficial ownership information where required, and related verification records;
  • Menu content, pricing, and operating hours;
  • Order and transaction data processed through the Platform;
  • Communications with our account management and support teams.

2.2 Information Collected Automatically
  • IP address, browser type, operating system, and device identifiers;
  • Pages visited, links clicked, and time spent on the Platform;
  • Referring URLs and search terms used to find the Platform;
  • Order activity and session data;
  • Location data if you enable location services on your device.

2.3 Information from Cookies and Tracking Technologies

We use cookies, pixel tags, and similar tracking technologies to enhance your experience and measure Platform performance.

  • Essential Cookies: Required for the Platform to function, including session management and security.
  • Analytics Cookies: We use Google Tag Manager and associated Google Analytics tools.
  • Marketing Pixels: We use Meta Pixel (Facebook Pixel) to measure advertising effectiveness and targeted advertising.
  • Preference Cookies: Used to remember your settings and preferences.

2.4 Information from Third Parties
  • Square, in connection with payment processing;
  • Dwolla, in connection with Restaurant Partner payout verification and disbursement;
  • DoorDash, in connection with delivery order status and fulfillment;
  • Meta Platforms, in connection with advertising campaign performance;
  • Google, in connection with analytics and advertising measurement;
  • App stores (Apple App Store, Google Play);
  • Verification, compliance, fraud-prevention, banking, and payment partners.

3. HOW WE USE YOUR INFORMATION
  • Processing and fulfilling Orders;
  • Facilitating payment collection and Restaurant Partner payouts;
  • Enabling delivery through DoorDash;
  • Managing accounts and order history;
  • Operating Loyalty Programs and Gift Cards;
  • Sending Order confirmations and support responses;
  • Improving Platform performance and services;
  • Detecting fraud and abuse;
  • Complying with legal obligations;
  • Advertising and marketing purposes.

4. HOW WE SHARE YOUR INFORMATION

We do not sell your personal information for money. However, certain advertising and analytics technologies may be considered sharing under applicable privacy laws.


4.1 Service Providers and Partners

We share information with third-party companies that help us operate the Platform:

4.1A Sensitive Business and Identity Information

We may collect and process sensitive business and identity verification information for onboarding, payout processing, fraud prevention, tax reporting, compliance, account security, and legal purposes.


4.2 Restaurant Partners

When you place an Order, we share your name, contact information, delivery address, and order details with the Restaurant Partner fulfilling your Order.


4.3 Legal Requirements

We may disclose your information if required by law, court order, or government authority.


4.4 Business Transfers

In the event of a merger, acquisition, reorganization, or sale of assets, your information may be transferred.


4.5 Aggregated and De-Identified Data

We may share aggregated or de-identified data for research, marketing, and operational purposes.


5. DATA RETENTION

We retain information as long as necessary to provide services, comply with legal obligations, prevent fraud, resolve disputes, and enforce agreements.


6. SECURITY

We implement industry-standard security measures including SSL/TLS encryption, encrypted storage, access controls, security monitoring, and PCI DSS compliant payment processing through Square.

10. CHILDREN'S PRIVACY

The Platform is not directed to children under 13 years of age.


11. THIRD-PARTY LINKS AND SERVICES

The Platform may contain links to third-party websites and services including Square, DoorDash, and Meta.


12. MOBILE APPLICATION

Our mobile application may collect device identifiers, push notification tokens, and location data if permissions are granted.


13. EMAIL COMMUNICATIONS AND CAN-SPAM COMPLIANCE

All promotional emails comply with the CAN-SPAM Act and include unsubscribe functionality.


14. CHANGES TO THIS POLICY

App2Food reserves the right to update this Policy at any time.
